Terms of Use

These terms explain what PhoneParental is for, who may use it, and the responsibilities that come with lawful, authorized monitoring. Please read them carefully before using the Service.

Authorized use only — please read

PhoneParental is monitoring software intended solely for lawful, authorized monitoring: monitoring your own minor children's devices as their parent or legal guardian, monitoring company-owned devices with proper disclosure to the people who use them, or monitoring a device that belongs to you. Installing or using monitoring software on a device you do not own or are not authorized to monitor, or without legally required consent, may be a criminal offense and is strictly prohibited.

1. Acceptance of these terms

These Terms of Use ("Terms") govern your access to and use of the PhoneParental website, applications and services (together, the "Service"). By creating an account, installing the software, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Who may use PhoneParental

You must be at least 18 years old and able to form a legally binding contract to use PhoneParental. By using the Service you represent that you meet these requirements and that all information you provide is accurate.

3. Permitted use and your responsibilities

PhoneParental may be used only for lawful purposes and only in the following circumstances:

You are solely responsible for ensuring that your use of PhoneParental complies with all laws, regulations and rules that apply to you, including laws relating to privacy, surveillance, communications, recording of calls or audio, and employment. Laws differ significantly between countries, states and regions. It is your responsibility — not ours — to understand and follow them. Where the law requires you to notify or obtain the consent of the person being monitored, you must do so before using the Service.

4. Prohibited use

You must not use PhoneParental to monitor any person or device without the legal right to do so. Prohibited uses include, without limitation: monitoring another adult without their knowledge or consent where consent is legally required; installing the software on a device you neither own nor are authorized to manage; stalking, harassing, intimidating or harming any person; or any other use that violates applicable law. We do not condone and expressly prohibit the use of PhoneParental as "stalkerware" or for any covert surveillance that is unlawful.

If we become aware of use that violates these Terms or applicable law, we may suspend or terminate your account without notice and may cooperate with law enforcement as required.

5. Disclosure and transparency

We strongly encourage transparency with anyone whose device you monitor. In many places, transparency is not merely good practice but a legal requirement. For employee monitoring, you should maintain a clear, written monitoring policy that your staff have acknowledged. For family monitoring, age-appropriate conversations about safety and monitoring are both healthier and, in many jurisdictions, legally relevant.

6. Accounts and security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us promptly of any unauthorized use. We are not liable for any loss arising from your failure to safeguard your credentials.

7. Subscriptions, billing and refunds

PhoneParental is offered on a subscription basis. By purchasing a subscription you authorize us or our payment processors to charge the applicable fees, including automatic renewal at the end of each billing period unless you cancel beforehand. You may cancel at any time from your account; cancellation takes effect at the end of the current billing period. Refunds, where offered, are governed by the refund terms presented at the time of purchase.

8. Intellectual property

The Service, including its software, design, text, graphics and trademarks, is owned by PhoneParental or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms. You may not copy, modify, reverse engineer, resell or create derivative works from the Service except as permitted by law.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or compatible with every device or operating system, and feature availability may change as platforms and operating systems evolve.

10. Limitation of liability

To the maximum extent permitted by law, PhoneParental and its officers, employees and affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from or related to your use of, or inability to use, the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless PhoneParental from any claims, damages, liabilities and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or the rights of any third party — including any claim arising from monitoring a person or device without the required authorization or consent.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if we are required to do so by law, or if continued provision of the Service becomes impractical. Provisions that by their nature should survive termination will survive.

13. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the "last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
